Khardiata Tandian still awaits a definitive ruling on her fate in the ongoing case concerning the alleged falsification of Ousmane Sonko’s signature. Although the Dakar Criminal Court was scheduled to deliver its verdict on Thursday, July 9, 2026, the presiding judge opted to defer the deliberation once more.
This marks the second postponement recorded in this significant dossier. The court has now rescheduled the pronouncement of its decision for July 23.
The latest deferral stems from the same rationale as the previous one: the tribunal seeks the appearance of another individual implicated in the proceedings.
Alleged accomplice absent during proceedings
The case extends beyond Khardiata Tandian. An individual identified as her alleged accomplice, Chérif Zeyni Abidin Sy, is also required to appear.
He was not present during the trial. His testimony is deemed crucial before the court can render a final judgment on the matter.
Consequently, the judge decided to push back the deliberation yet again, pending his presence. The legal process thus remains suspended until the new date set by the jurisdiction.
Defense counsel leverages postponement to seek provisional release
Taking advantage of this new deferral, Khardiata Tandian’s legal representative submitted a motion for provisional release.
Counsel argued that his client fulfilled the necessary criteria for this measure. To support his request, he highlighted that all official reports pertinent to the case had already been submitted into the legal record.
The defense contended, therefore, that the continued detention of his client is no longer essential for the proper conduct of the investigation or the judgment.
No risk of witness intimidation, according to counsel
The lawyer also asserted that there was no risk of witness tampering. He maintained that Khardiata Tandian’s release would neither jeopardize testimonies nor incite disturbances directly related to the proceedings.
Regarding any potential risk of facts being misrepresented, the defense contended that such a scenario is now impossible, as the accused has already testified before the court.
For her counsel, the primary procedural steps have therefore been completed, and the case’s elements are now known to the judiciary.
Over a year in detention cited by defense
The lawyer further emphasized the duration of Khardiata Tandian’s detention. She has been incarcerated for over a year.
According to the defense, the time already spent in detention could potentially cover any sentence that might be imposed. This argument was used to persuade the tribunal that her continued incarceration was no longer justified.
Counsel also drew the judges’ attention to the deteriorating social circumstances of his client.
A ‘mother of a family’ facing worsening conditions
The defense reminded the court that Khardiata Tandian is a married woman and a mother of one child. Her extended incarceration, according to her lawyer, is having increasingly severe repercussions on her family and social life.
Through these various arguments, the defense counsel hoped to secure a provisional release measure pending the deliberation now programmed for July 23.
However, this request met with opposition from the public prosecutor.
Prosecution cites public order disturbance
The prosecutor opposed the release of the accused. For the representative of the public ministry, such a measure would constitute a disturbance to public order.
The prosecution also deemed that Khardiata Tandian did not offer sufficient guarantees of her appearance in court. In other words, it considered that the conditions ensuring her presence before the court until the conclusion of the proceedings were not met.
These arguments ultimately convinced the tribunal.
Request denied, Khardiata Tandian remains in detention
After hearing both the defense and the public prosecutor, the Dakar Criminal Court decided to uphold the prosecutor’s stance.
The request for provisional release was therefore rejected. Khardiata Tandian remains in detention, awaiting the continuation of the proceedings and the new deliberation scheduled for July 23.
The case thus remains open on two fronts. On one hand, the court still awaits the appearance of Chérif Zeyni Abidin Sy, identified as an alleged accomplice. On the other hand, Khardiata Tandian will have to wait in prison until the next judicial deadline.
Case still suspended pending appearance of second accused
The resolution of the case now hinges on the alleged accomplice’s presence at the next hearing. His prior absence had already prevented the court from rendering its decision on the initially scheduled date.
The latest postponement indicates the court’s desire to have all evidence and hear from all implicated parties before issuing a definitive ruling.
Barring any further changes, Khardiata Tandian will learn her fate on the upcoming July 23. Until then, she will remain in custody, as her request for provisional release failed to persuade the judges.
