Former Congolese President Joseph Kabila has launched a legal challenge in a United States federal court, seeking to overturn sanctions Washington imposed in April 2026. The American government alleges his support for the M23 rebel group and the Alliance Fleuve Congo, accusations the former head of state vehemently refutes.

Early in August, Joseph Kabila formally approached the American judiciary, aiming to reverse his inclusion on the Office of Foreign Assets Control (OFAC) blacklist. This Treasury Department entity is responsible for enforcing US economic sanctions. In a sixteen-page complaint, his legal representatives dispute Washington’s decision, asserting the allegations lack adequate substantiation.
Kabila rejects allegations
American authorities have accused the former president of providing both financial and logistical backing to the Alliance Fleuve Congo (AFC), a political and military coalition where the M23 constitutes its primary force. Washington also criticizes him for allegedly encouraging Congolese military personnel to desert and for residing in Goma, eastern Democratic Republic of Congo, under M23’s protection. Joseph Kabila categorically denies these claims. His defense team contends that the evidence presented by the US administration is « vague » and « arbitrary, » failing to concretely establish the alleged facts.
Defense demands concrete evidence
The former president’s legal counsel specifically highlights the absence of any identified precise financial transfers to the AFC within the American dossier. Furthermore, they assert that no specific Congolese military members are named as having been enticed to desert by Joseph Kabila. His defense also points out that in 2013, during his presidency, the Congolese army played a crucial role in the M23’s defeat.

Joseph Kabila, who governed the Democratic Republic of Congo from 2001 to 2019, is now petitioning the federal court in Washington to lift the sanctions and remove his name from the OFAC list.
